Health Safety Net Third Party Liability
SECTION 78.
Paragraph (2) of subsection (a) of section 39 of said chapter 118G, as appearing in section 15 of chapter 61 of the acts of 2007, is hereby amended by inserting after the first sentence the following 2 sentences:- The office may recover from a third party that is financially responsible for the costs attributable to services provided to an individual that were paid by the fund. A payment from the fund for such services shall be recoverable from the third party and the payment shall, after notice to the third party, operate as a lien under section 22 of chapter 118E.
