| 4512-1500 | Federally Required & Intergovernmental Retained Revenues The department of public health may expend for the human immunodeficiency virus and acquired immune deficiency syndrome drug assistance program an amount not to exceed $1,500,000 from revenues received from pharmaceutical manufacturers participating in the section 340B rebate program of the Public Health Services Act, administered by the federal Health Resources and Services Administration and office of Pharmacy Affairs; provided, that the department may expend for inmate medical services provided by the Lemuel Shattuck hospital an amount not to exceed $4,160,000 from payments received from the vender managing health services; provided further, that the department may expend for supplemental food, healthcare referrals and nutrition education for pregnant and breastfeeding women, infants and children up to age 5 an amount not to exceed $26,875,000 from revenues received from the federal cost-containment initiative including, but not limited to, infant formula; provided further, that the department may expend for the regulation of all pharmaceutical and medical device companies that market their products in Massachusetts an amount not to exceed $640,000 from fees assessed under chapter 111N of the General Laws; and provided further, that notwithstanding any general or special law to the contrary, for the purpose of accommodating timing discrepancies between the receipt of revenues and related expenditures, the department may incur expenses and the comptroller may certify for payment amounts not to exceed the lesser of this authorization or the most recent revenue estimate, as reported in the state accounting system |
