8311-1000 | Department of Public Safety and Inspections
For the administration of the department of public safety, including the division of inspections, the board of building regulations and standards and the architectural access board; provided, that the department may charge fees for amusement operator certification; provided further, that the department shall attempt to employ more than 70 full-time equivalent elevator inspectors, including an additional engineer inspector; including an additional engineer inspector; provided further, that the department shall adopt rules or regulations for the granting of hardship fee exemptions to certain owners or persons in control of a building or domicile in which an elevator is operated; provided further, that the division shall report to the house and senate committees on ways and means on the elevator inspection backlog no later than October 3, 2016; provided further, that the division shall maintain an electronic database that shall include, but not be limited to, the location and a categorical classification of buildings in which inspections are conducted; and provided further, that the division shall inspect all elevators in the state house and the McCormack office building |

For the department of public safety which may expend not more than $9,491,889 in revenues collected from fees for annual elevator inspections and amusement park ride inspections; provided, that funds shall be expended for the operation of the department, to address the existing elevator inspection backlog and to defray the costs associated with performing overtime elevator inspections; provided further, that the committee shall maintain at a minimum the existing level of elevator inspectors to further manage the existing elevator inspections backlog; provided further, that the department shall make efforts to employ inspectors to perform overnight and weekend inspections during their regular work shifts; provided further, that funds shall be expended for escalator inspections; provided further, that the department shall provide a full waiver of the inspection fee for an individual who requires a wheelchair lift as a medical necessity and whose annual income does not exceed the maximum allowable federal Supplemental Security Income benefit or $7,236 a year, whichever is greater; and provided further, that for the purpose of accommodating timing discrepancies between the receipt of retained revenues and related expenditures, the department may incur expenses and the comptroller may certify for payment amounts not to exceed the lower of this authorization or the most recent revenue estimate as reported in the state accounting system |

For the department of public safety which may expend an amount not more than $155,150 in revenues from fines collected under section 65 of chapter 143 of the General Laws and fees for appeals of civil fines issued under section 22 of chapter 22 of the General Laws and said section 65 of said chapter 143; provided, that funds shall be expended for the operation of the department in effectuating a procedure by which all or a portion of the $100 per day fine issued under said section 65 of said chapter 143 may be waived by the commissioner or the commissioner's designee |
