Section 51 MassHealth Overpayment Recovery
The fourth paragraph of section 38 of said chapter 118E, as so appearing, is hereby amended by adding the following sentence:- Notwithstanding any general or special law to the contrary, the division and its contracted managed care entities shall issue notice of overpayment to a provider only within 6 years after the conclusion of any internal or third-party audit, investigation or finding related to the overpayment, and the division and its contracted managed care entities shall be entitled to assert a right to recover any such overpayment.
