SECTION 44.
The third paragraph of the definition of "Regular compensation" in section 1 of chapter 32 of the General Laws, inserted by section 23 of chapter 131 of the acts of 2010, is hereby amended by striking out the second sentence and inserting in place thereof the following sentence:- Faculty, librarians and administrators in public higher education who are eligible for the state employees' retirement system shall not be prohibited from participating in the optional retirement program pursuant to section 40 of chapter 15A.
