Massachusetts Hospital School Revenue Recovery

SECTION 36.   Notwithstanding any general or special law to the contrary, the city or town, charter school or regional school district that is responsible or assumes responsibility for a child who is admitted to the Massachusetts hospital school shall reimburse the commonwealth for the cost of the services provided by the Massachusetts hospital school that are described in the child's Individualized Education Plan. To the extent such services are eligible for federal financial participation under Title XIX or XXI of the social security act, such costs shall not exceed the non-federal share of such services.
 
 

Summary:
This section requires each city or town, charter school or regional school district that assumes responsibility for a child admitted to the Massachusetts Hospital School to reimburse the Commonwealth for services provided by the school as described in the child's special education plan.
