4000-0640	MassHealth Nursing Home Supplemental Rates For nursing facility Medicaid rates; provided, that notwithstanding any general or special law to the contrary, in fiscal year 2016 the executive office of health and human services, in consultation with the center for health information and analysis, shall establish nursing facility Medicaid rates that cumulatively total at least $297,600,000 more than the annual payment rates established under the rates in effect as of June 30, 2002; provided further, that the payments made pursuant to this item shall be allocated in an amount sufficient to implement section 622 of chapter 151 of the acts of 1996; provided further, that not less than $2,800,000 shall be expended on a MassHealth nursing facility pay for performance program; and provided further, that notwithstanding any general or special law to the contrary, the secretary of health and human services may, in the secretary's discretion, either increase the nursing facility Medicaid rates established under to this item by an amount not to exceed the remaining appropriation under this item, or transfer up to an amount not to exceed to the remaining appropriation under this item to item 4000-0600 for the purpose of establishing nursing facility Medicaid rates using a base year subsequent to calendar year 2007	302,900,000	332,900,000
